Supreme Council Member and Ruler of Sharjah, His Highness Sheikh Dr. Sultan bin Muhammad Al Qasimi, has ordered the juridical authority to grant discretion in the custody cases. Now, the new guidance allows divorced fathers to take their children outside designated visitation centres when it serves the best interests of the children through new visitation rules for divorced fathers.
The decision was announced on Al Khat Al Mubasher (The Direct Line), which is a daily call-in programme of Sheikh Sultan on Sharjah Radio and Television. Notably, the move comes after a father (Abu Hamdan) shared his struggles under the current visitation center.
A Father’s Plea Leads to Change
After his divorce, Abu Hamdan explained that he was only allowed to meet his children inside a supervised room at the Social Services Department. He described the experience as humiliation. However, he said, “It feels as though I am serving a sentence.”
Deeply moved, Sheikh Sultan immediately ordered the Sharjah Department of Justice to amend the policy. Now, judges will be able to make case-by-case decisions. So, it ensures that the welfare of children remains the top priority.
Conditions for new visitation rules for divorced fathers
Under the updated rules, fathers can take their children outside the state facilities, like visiting relatives or enjoying an outing. However, fathers should have no history of abuse or violence.
Sheikh Sultan highlights, “The welfare of children must always come first”. In addition, he also said that fathers should have the right to see their children “free from pressure”. It highlights his commitment to family unity and child well-being.
Why This Matters for Families in the UAE?
The directive shows the proactive approach of Sharjah to family law. So, it aims to balance the parental rights with the needs of children. By allowing judges more flexibility, the emirate ensures that custody and visitation arrangements serve the emotional and social development of children while respecting the dignity of both parents.
This decision shows a chance to develop a meaningful relationship with their children for divorced fathers in Sharjah beyond the confines of the supervised visitation room.
Key takeaways
This rule of Sheikh Sultan highlights the dedication of the UAE to justice and family welfare. So, the nation is setting a compassionate example for other regions. Thus, families across Sharjah can now expect more personalized custody that puts children first and gives parents fair access.
